2. Anwendungsbereich

Diese Erklärung gilt für den geschäftlichen (B2B-)Vorgang rund um Sponsoren-Banner: das Buchungs-Formular auf der Website clevercrewconnect.org sowie die einmalige Hinweis-E-Mail zu den Sponsoring-Möglichkeiten an Organisations-Administratoren. Sie richtet sich an die für eine Organisation handelnden Administratoren, nicht an Endnutzende der App.

Für die Bearbeitung personenbezogener Daten innerhalb der App gilt die separate Datenschutzerklärung. Für die vertraglichen Bedingungen der Sponsoren-Buchung gelten die B2B-AGB für Sponsoren-Banner.

3. Welche Daten werden bearbeitet

3.1 Sponsoren-Banner-Buchung (Website-Formular)

Reicht ein Organisations-Administrator über das Formular ein Sponsoren-Banner ein, werden erfasst:

  • Offizieller Name der Organisation
  • Rechnungsadresse (Strasse und Nummer, PLZ, Ort, Land)
  • Umsatzsteuer- bzw. MwSt-/UID-Nummer (sofern angegeben)
  • Kontakt- bzw. Rechnungs-E-Mail-Adresse
  • Zustimmung zu den B2B-AGB (mit Zeitpunkt, Nachweiszweck)
  • Das hochgeladene Banner-Bild sowie die gewählte Saison

Das Formular ist durch Cloudflare Turnstile gegen automatisierte Eingaben geschützt (siehe Abschnitt 6).

3.2 Hinweis-E-Mail zu Sponsoring-Möglichkeiten

Nach der Freischaltung einer neuen Organisation wird einmalig eine Hinweis-E-Mail zu den Sponsoring-Möglichkeiten an die Organisations-Administratoren versandt. Dafür verarbeitet werden: E-Mail-Adresse, Vorname und Organisationsname der empfangenden Person.

4. Zwecke der Bearbeitung

  • Abwicklung und Rechnungsstellung der technischen Gebühr für das Sponsoren-Banner (B2B-Kontext)
  • Manuelle Prüfung und Freischaltung des eingereichten Banners
  • Information der Organisations-Administratoren über die Sponsoring-Möglichkeit (einmalige Hinweis-E-Mail)

5. Rechtsgrundlagen

  • Vertragserfüllung / Vertragsanbahnung (Art. 31 Abs. 2 lit. a revDSG / Art. 6 Abs. 1 lit. b DSGVO) für die Abwicklung und Rechnungsstellung der Banner-Buchung.
  • Rechtliche Verpflichtung (Art. 6 Abs. 1 lit. c DSGVO) für die Aufbewahrung von Rechnungs- und Geschäftsunterlagen.
  • Berechtigtes Interesse (Art. 31 Abs. 2 lit. d revDSG / Art. 6 Abs. 1 lit. f DSGVO) an der einmaligen Information der Administratoren über die Sponsoring-Möglichkeit. Diesem Versand kannst du jederzeit per E-Mail an support@clevercrewconnect.org widersprechen.

6. Weitergabe an Dritte und Auftragsverarbeiter

  • Supabase Inc. (Datenbank/Storage, Region EU-Frankfurt) — Speicherung der Buchungs- und Rechnungsdaten sowie des Banner-Bilds. Drittlandtransfer auf Basis der EU-Standardvertragsklauseln (Art. 46 DSGVO).
  • Cloudflare Inc. (Turnstile, Bot-Schutz) — IP-Adresse, Browser-Fingerprint und Verhaltens-Heuristiken zur Bot-Erkennung beim Formular. Speicherung gemäss Cloudflare-Richtlinie max. 30 Tage.
  • Infomaniak Network SA (Genf, Schweiz) — Versand der Hinweis-E-Mail. Standort Schweiz, kein Drittlandtransfer.

7. Speicherort und Speicherdauer

  • Server: EU (Frankfurt) bei Supabase
  • Rechnungs- und Buchungsdaten: gemäss den gesetzlichen handels- und steuerrechtlichen Aufbewahrungspflichten (in der Regel 10 Jahre)
  • Banner-Bild: solange das Sponsoring aktiv ist bzw. für die Dauer der gebuchten Saison; danach Entfernung im Rahmen der Storage-Bereinigung
  • Hinweis-E-Mail: es wird kein eigener E-Mail-Verlauf gespeichert; lediglich ein technischer Vermerk, dass der einmalige Versand erfolgt ist

8. Rechte der betroffenen Person

Sie haben das Recht auf Auskunft, Berichtigung, Löschung (im Rahmen der gesetzlichen Aufbewahrungspflichten), Einschränkung, Datenübertragbarkeit sowie auf Widerspruch gegen eine auf berechtigtem Interesse gestützte Bearbeitung. Anfragen richten Sie bitte an support@clevercrewconnect.org; wir bearbeiten sie innerhalb von 30 Tagen.

Beschwerden können Sie bei der zuständigen Datenschutzbehörde einreichen — in der Schweiz beim EDÖB (www.edoeb.admin.ch), in der EU bei der für Ihren Sitz zuständigen Aufsichtsbehörde.

9. Änderungen

Diese Erklärung wird bei wesentlichen Änderungen am B2B-Sponsoring-Prozess angepasst. Die jeweils aktuelle Version ist unter clevercrewconnect.org abrufbar.

2. Scope

This policy applies to the commercial (B2B) process around sponsor banners: the booking form on the website clevercrewconnect.org as well as the one-time informational email about the sponsoring options sent to organization administrators. It is addressed to the administrators acting on behalf of an organization, not to end users of the App.

For the processing of personal data within the App, the separate Privacy Policy applies. For the contractual terms of the sponsor booking, the B2B Terms for Sponsor Banners apply.

3. What data is processed

3.1 Sponsor banner booking (website form)

When an organization administrator submits a sponsor banner via the form, the following is collected:

  • Official name of the organization
  • Billing address (street and number, postal code, city, country)
  • VAT or sales-tax/UID number (if provided)
  • Contact or billing email address
  • Consent to the B2B Terms (with timestamp, for evidence purposes)
  • The uploaded banner image as well as the selected season

The form is protected against automated input by Cloudflare Turnstile (see section 6).

3.2 Informational email about sponsoring options

After the activation of a new organization, a one-time informational email about the sponsoring options is sent to the organization administrators. For this, the following is processed: email address, first name and organization name of the recipient.

4. Purposes of processing

  • Handling and invoicing of the technical fee for the sponsor banner (B2B context)
  • Manual review and activation of the submitted banner
  • Information of the organization administrators about the sponsoring option (one-time informational email)

5. Legal bases

  • Performance of contract / pre-contractual measures (Art. 31 para. 2 lit. a revFADP / Art. 6 para. 1 lit. b GDPR) for the handling and invoicing of the banner booking.
  • Legal obligation (Art. 6 para. 1 lit. c GDPR) for the retention of invoicing and business records.
  • Legitimate interest (Art. 31 para. 2 lit. d revFADP / Art. 6 para. 1 lit. f GDPR) in the one-time information of administrators about the sponsoring option. You can object to this dispatch at any time by email to support@clevercrewconnect.org.

6. Disclosure to third parties and data processors

  • Supabase Inc. (database/storage, region EU-Frankfurt) — storage of the booking and invoicing data as well as of the banner image. Third-country transfer on the basis of the EU Standard Contractual Clauses (Art. 46 GDPR).
  • Cloudflare Inc. (Turnstile, bot protection) — IP address, browser fingerprint and behavioral heuristics for bot detection on the form. Storage in accordance with the Cloudflare policy for a maximum of 30 days.
  • Infomaniak Network SA (Geneva, Switzerland) — dispatch of the informational email. Location Switzerland, no third-country transfer.

7. Storage location and retention period

  • Server: EU (Frankfurt) at Supabase
  • Invoicing and booking data: in accordance with the statutory commercial and tax retention obligations (as a rule 10 years)
  • Banner image: as long as the sponsoring is active or for the duration of the booked season; afterwards removal as part of the storage cleanup
  • Informational email: no separate email history is stored; only a technical note that the one-time dispatch has taken place

8. Rights of the data subject

You have the right to access, rectification, erasure (within the scope of the statutory retention obligations), restriction, data portability as well as to object to a processing based on legitimate interest. Please direct requests to support@clevercrewconnect.org; we process them within 30 days.

You may lodge complaints with the competent data protection authority — in Switzerland with the FDPIC (www.edoeb.admin.ch), in the EU with the supervisory authority competent for your place of establishment.

9. Changes

This policy will be adapted in case of substantial changes to the B2B sponsoring process. The respective current version is accessible at clevercrewconnect.org.

2. Champ d'application

La présente déclaration s'applique à l'opération commerciale (B2B) relative aux bannières de sponsors : le formulaire de réservation sur le site web clevercrewconnect.org ainsi que l'e-mail d'information unique sur les possibilités de sponsoring adressé aux administrateurs d'organisation. Elle s'adresse aux administrateurs agissant pour le compte d'une organisation, et non aux utilisateur·rice·s finaux de l'Application.

Pour le traitement des données personnelles au sein de l'Application s'applique la politique de confidentialité distincte. Pour les conditions contractuelles de la réservation de sponsoring s'appliquent les CGU B2B pour bannières de sponsors.

3. Quelles données sont traitées

3.1 Réservation d'une bannière de sponsor (formulaire du site web)

Lorsqu'un administrateur d'organisation soumet une bannière de sponsor via le formulaire, les données suivantes sont collectées :

  • Nom officiel de l'organisation
  • Adresse de facturation (rue et numéro, code postal, localité, pays)
  • Numéro de TVA ou d'identification (UID) (si indiqué)
  • Adresse e-mail de contact ou de facturation
  • Consentement aux CGU B2B (avec horodatage, à des fins de preuve)
  • L'image de bannière téléversée ainsi que la saison choisie

Le formulaire est protégé contre les saisies automatisées par Cloudflare Turnstile (voir section 6).

3.2 E-mail d'information sur les possibilités de sponsoring

Après l'activation d'une nouvelle organisation, un e-mail d'information unique sur les possibilités de sponsoring est envoyé aux administrateurs d'organisation. Pour cela sont traités : l'adresse e-mail, le prénom et le nom de l'organisation de la personne destinataire.

4. Finalités du traitement

  • Traitement et facturation de la redevance technique pour la bannière de sponsor (contexte B2B)
  • Vérification et activation manuelles de la bannière soumise
  • Information des administrateurs d'organisation sur la possibilité de sponsoring (e-mail d'information unique)

5. Bases juridiques

  • Exécution du contrat / mesures précontractuelles (art. 31 al. 2 let. a nLPD / art. 6 al. 1 let. b RGPD) pour le traitement et la facturation de la réservation de bannière.
  • Obligation légale (art. 6 al. 1 let. c RGPD) pour la conservation des documents de facturation et commerciaux.
  • Intérêt légitime (art. 31 al. 2 let. d nLPD / art. 6 al. 1 let. f RGPD) à l'information unique des administrateurs sur la possibilité de sponsoring. Vous pouvez vous opposer à tout moment à cet envoi par e-mail à support@clevercrewconnect.org.

6. Transmission à des tiers et sous-traitants

  • Supabase Inc. (base de données/stockage, région UE-Francfort) — stockage des données de réservation et de facturation ainsi que de l'image de bannière. Transfert vers un pays tiers sur la base des clauses contractuelles types UE (art. 46 RGPD).
  • Cloudflare Inc. (Turnstile, protection anti-bots) — adresse IP, empreinte du navigateur et heuristiques comportementales pour la détection de bots sur le formulaire. Stockage conforme à la politique de Cloudflare pendant 30 jours maximum.
  • Infomaniak Network SA (Genève, Suisse) — envoi de l'e-mail d'information. Localisation en Suisse, pas de transfert vers un pays tiers.

7. Lieu et durée de stockage

  • Serveur : UE (Francfort) chez Supabase
  • Données de facturation et de réservation : conformément aux obligations légales de conservation en matière commerciale et fiscale (en règle générale 10 ans)
  • Image de bannière : tant que le sponsoring est actif ou pour la durée de la saison réservée ; ensuite suppression dans le cadre du nettoyage du stockage
  • E-mail d'information : aucun historique d'e-mail propre n'est stocké ; uniquement une note technique indiquant que l'envoi unique a eu lieu

8. Droits de la personne concernée

Vous avez le droit d'accès, de rectification, de suppression (dans le cadre des obligations légales de conservation), de limitation, de portabilité des données ainsi que d'opposition à un traitement fondé sur l'intérêt légitime. Veuillez adresser vos demandes à support@clevercrewconnect.org ; nous les traitons dans un délai de 30 jours.

Vous pouvez déposer une réclamation auprès de l'autorité de protection des données compétente — en Suisse auprès du PFPDT (www.edoeb.admin.ch), dans l'UE auprès de l'autorité de contrôle compétente pour votre siège.

9. Modifications

La présente déclaration sera adaptée en cas de modifications substantielles du processus de sponsoring B2B. La version actuellement en vigueur est accessible sur clevercrewconnect.org.

2. Ambito di applicazione

La presente informativa si applica al procedimento commerciale (B2B) relativo ai banner sponsor: il modulo di prenotazione sul sito web clevercrewconnect.org nonché l'e-mail informativa una tantum sulle possibilità di sponsorizzazione inviata agli amministratori di organizzazione. Si rivolge agli amministratori che agiscono per conto di un'organizzazione, non agli utenti finali dell'App.

Per il trattamento dei dati personali all'interno dell'App si applica la separata Informativa sulla privacy. Per le condizioni contrattuali della prenotazione sponsor si applicano le Condizioni B2B per i banner sponsor.

3. Quali dati vengono trattati

3.1 Prenotazione del banner sponsor (modulo del sito web)

Quando un amministratore di organizzazione presenta un banner sponsor tramite il modulo, vengono raccolti:

  • Nome ufficiale dell'organizzazione
  • Indirizzo di fatturazione (via e numero, CAP, città, paese)
  • Numero di partita IVA o di identificazione fiscale (se indicato)
  • Indirizzo e-mail di contatto o di fatturazione
  • Consenso alle Condizioni B2B (con data/ora, a fini di prova)
  • L'immagine del banner caricata nonché la stagione selezionata

Il modulo è protetto da Cloudflare Turnstile contro le immissioni automatizzate (vedi sezione 6).

3.2 E-mail informativa sulle possibilità di sponsorizzazione

Dopo l'attivazione di una nuova organizzazione, viene inviata una tantum un'e-mail informativa sulle possibilità di sponsorizzazione agli amministratori di organizzazione. A tal fine vengono trattati: indirizzo e-mail, nome e nome dell'organizzazione della persona destinataria.

4. Finalità del trattamento

  • Gestione e fatturazione della tariffa tecnica per il banner sponsor (contesto B2B)
  • Verifica e attivazione manuali del banner presentato
  • Informazione degli amministratori di organizzazione sulla possibilità di sponsorizzazione (e-mail informativa una tantum)

5. Basi giuridiche

  • Esecuzione del contratto / Misure precontrattuali (art. 31 cpv. 2 lett. a nLPD / art. 6 par. 1 lett. b GDPR) per la gestione e la fatturazione della prenotazione del banner.
  • Obbligo legale (art. 6 par. 1 lett. c GDPR) per la conservazione dei documenti di fatturazione e commerciali.
  • Interesse legittimo (art. 31 cpv. 2 lett. d nLPD / art. 6 par. 1 lett. f GDPR) all'informazione una tantum degli amministratori sulla possibilità di sponsorizzazione. Lei può opporsi a tale invio in qualsiasi momento scrivendo un'e-mail a support@clevercrewconnect.org.

6. Trasmissione a terzi e responsabili del trattamento

  • Supabase Inc. (database/storage, regione UE-Francoforte) — memorizzazione dei dati di prenotazione e fatturazione nonché dell'immagine del banner. Trasferimento verso paesi terzi sulla base delle clausole contrattuali standard UE (art. 46 GDPR).
  • Cloudflare Inc. (Turnstile, protezione anti-bot) — indirizzo IP, fingerprint del browser ed euristiche comportamentali per il riconoscimento di bot sul modulo. Memorizzazione conformemente alla policy di Cloudflare per un massimo di 30 giorni.
  • Infomaniak Network SA (Ginevra, Svizzera) — invio dell'e-mail informativa. Ubicazione in Svizzera, nessun trasferimento verso paesi terzi.

7. Luogo e durata di conservazione

  • Server: UE (Francoforte) presso Supabase
  • Dati di fatturazione e prenotazione: conformemente agli obblighi legali di conservazione in materia commerciale e fiscale (di regola 10 anni)
  • Immagine del banner: finché la sponsorizzazione è attiva ovvero per la durata della stagione prenotata; successivamente rimozione nell'ambito della pulizia dello storage
  • E-mail informativa: non viene memorizzato alcun proprio storico delle e-mail; soltanto un'annotazione tecnica che attesta l'avvenuto invio una tantum

8. Diritti dell'interessato

Lei ha il diritto di accesso, rettifica, cancellazione (nei limiti degli obblighi legali di conservazione), limitazione, portabilità dei dati nonché di opposizione a un trattamento fondato sull'interesse legittimo. Le richieste vanno indirizzate a support@clevercrewconnect.org; le trattiamo entro 30 giorni.

Lei può presentare reclamo presso l'autorità competente in materia di protezione dei dati — in Svizzera presso l'IFPDT (www.edoeb.admin.ch), nell'UE presso l'autorità di controllo competente per la Sua sede.

9. Modifiche

La presente informativa viene adattata in caso di modifiche sostanziali al processo di sponsorizzazione B2B. La versione di volta in volta attuale è disponibile su clevercrewconnect.org.
